The NBA legend Tells Court He ‘Wasn’t Afraid’ of Nascar in Legal Battle
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and novelty within the sport motivated his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed operational insights of his 23XI team, saying he invested $40m of his personal wealth into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination through a new lens.”
The Core Dispute: Charter Agreements and Renewal Demands
At issue is the end of a 2016 agreement where Nascar provided each team a “charter”. This system mirrors other professional sports with separately owned franchises, such as the NBA’s Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with fans and media vying for a glimpse or a photo of the global icon.
Leading the Legal Charge
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to maintain excessive control.
For Jordan and and a fellow team representative, who testified before Jordan, are details from last September. Gibbs described a frantic and emotional period where the racing circuit told teams they must sign a contract extension. The document consists of 112 pages detailing team compensation and a guaranteed spot in every race.
A Refusal to Sign
Jordan explained that his team and its ally decided their only feasible option was to refuse a signature that 112-page package and take the issue to court. All other teams agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.
The Ultimate Motivation: Victory
But in the end, the resistance against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Success.
“Denny convinced me adding a third car boosted our odds of winning,” he said, sharing that he bought a third charter last year for $28 million amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.
According to her, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.
“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
