Federal Judge Mandates Release of Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her order, the judge noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
